1) How do I notice a motion or petition filed with a Request for Judicial Intervention?

2) How many copies of the Request for Judicial Intervention are required?

The original and one copy of the Request for Judicial Intervention are required to be filed with a notice of motion, a notice of petition or a request for a preliminary conference.

3) How many days in advance must I file a notice of motion or notice of petition?

A notice of motion or a notice of petition with a Request for Judicial Intervention must be filed a minimum of 9 business days prior to the return date in the notice, exclusive of the return date. Motions in post Request for Judicial Intervention matters must be filed a minimum of 5 business days prior to the return date in the notice, exclusive of the return date.

4) When will my motion or petition filed with a Request for Judicial Intervention appear on the assigned Justice’s calendar?

Queens has 29 Justices who hear motions and petitions on Tuesdays or Wednesdays in Jamaica or Thursdays in Long Island City. The original return date in your notice will appear in the database and the matter will be administratively rescheduled to the following week before the assigned Justice on their motion day.

5) When will my motion filed in a post Request for Judicial Intervention matter appear on the assigned Justice’s calendar?

The movant on an assigned matter is to notice any motion on the assigned Justice’s motion day. Failure to do so with no other glaring errors, the original return date in your notice will appear in the database and the Motion Support Office will administratively reschedule the motion to the following week. The movant shall be responsible for notifying all parties of the rescheduled date.

8) Where do I submit my responsive papers or cross motion to?

Papers in opposition, reply, affidavits/affirmations of service, memorandum of law and cross motions are considered responsive papers. Motion Support does not receive, process or forward any responsive papers to a motion in chief. Refer to the link in question #7 for the assigned Justice’s part rules on the submission of responsive papers. Counsel are reminded that cross motions are fee applicable applications and must be paid for at the County Clerk’s office prior to their submission.

9) What is the fee for filing a Request for Judicial Intervention, notice of motion, etc.?

The County Clerk, as a member of the Unified Court System, is a separate entity from the Supreme Court of Queens County. The County Clerk is responsible for the collection and processing of all fees and can be reached at 718-298-0601.

10) Once an order or decision has been rendered by the court, when can I get a copy?

When brought to the Motion Support Office by chambers for processing, all orders and decisions are entered into the Supreme Court’s database within a day. They are then brought to the County Clerk’s office the next business day for entering. They will be available in Room 100 of the County Clerk’s office within 2 or 3 business days.

11) I’ve checked on e-courts and I do not find the case I am looking for?

The data on e-courts is uploaded from the Supreme Court’s database. A case is only entered into the Supreme Court’s database upon the filing of a Request for Judicial Intervention. Questions regarding matters which have not filed a Request for Judicial Intervention should be addressed to the County Clerk at 718-298-0601.

12) What is the status of the Order to Show Cause I’ve recently filed?

The intake processing of Orders to Show Cause are handled by the Ex Parte department. Once an Order to Show Cause has been signed by a Justice, chambers will notify the movant. After it has been entered into the Supreme Court’s database, a copy is then entered by the County Clerk where copies may be retrieved.. k place.
