A guardianship petition under Article 81 of the Mental Hygiene Law is brought when a person requires some form of assistance in meeting their personal and property management needs. In the event that a finding of incapacity is made by the court, or upon the consent of the subject party, the court will direct the least restrictive form of intervention which assists them in meeting their personal and property management needs but, at the same time, permits them to exercise the independence and self-determination of which they are capable.
