CIVIL CASE OPERATIONS
REQUEST FOR JUDICIAL INTERVENTION (RJI)
(OR OTHER CASE INITIATION PAPERS)
DEFINITION:A RJI is the entry form that must accompany
the following papers upon initial submission to the court except
as noted further below:
Notice of Motion
Order to Show Cause
Application for an ex parte order
Notice of Petition
Note of Issue
Notice of Medical, Dental or Podiatric malpractice action
Statement of Net of Net Worth
No such papers shall be accepted unless accompanied by a
RJI. The submission of a RJI precedes the assignment of the
action to a judge. A fee of $75.00 for the filing of a RJI
must be paid to the county clerk unless exempt, pursuant to
CPLR 8017, or poor person relief has been granted. An original
RJI should remain with the county clerk either at time of filing
or following intake processing. A RJI is only required for
a new action, not for a case previously assigned. Only one
RJI is required per action.
Items exempted from RJI filing requirements, pursuant to
subdivision (b) of Section 202.6 of the Uniform Rules, include
but are not limited to:
a petition for the sale of church property
an application for the change of name
a habeas corpus proceeding where the movant is institutionalized
an application for default judgment to the clerk pursuant to
CPLR 3215(a)
an application under CPLR 3102 (c) for court assistance in
obtaining disclosure in an action pending
in another state
a retention proceeding authorized by Article 9 of the Mental
Hygiene Law
an appeal to a county court of a civil case brought in a court
of limited jurisdiction
an application to vacate a judgment on account of bankruptcy
a motion for an order authorizing emergency surgery
an uncontested action - within the City of New York - for a
judgment for annulment,
divorce or separation
commenced pursuant to Article 9, 10 or 11 of the Domestic Relations
Law, or an application not filed
in an action or proceeding, e.g. not-for-profit application,
pistol permit application (upstate only)
NOTE: A note of issue fee of $100.00 must be collected
by the county clerk for an uncontested matrimonial action in
New York City and for a case filed prior to 11/5/87, for which
no RJI fee was collected.
