The County Court is a court of record that has jurisdiction
of more serious criminal
matters and civil actions.
County Courts are located in each county outside New York City, handling
felony criminal cases, guardianships, mental health applications,
certain real estate matters, and civil cases that involve amounts of
up to
$25,000.00 in value. Both civil and criminal jury trials are
available for County Court matters.
|
Special Term is held each Wednesday morning, beginning
at 9:30. Criminal case conferences are generally held on Thursday mornings,
beginning at 9:00. Civil and criminal motions are generally made returnable
on Special Term days. The court, however, may schedule the return on
a motion at any time that it deems appropriate.
The County Court also hears appeals of Town Court and City Court
determinations as to both criminal and civil (including small
claims) matters. Those
who seek to appeal a civil decision from a lower court are referred
to Article 55 of the Civil Practice Law and Rules, Uniform City
Court Act §1704, and Uniform Justice Court Act §1704. These references
may be found in the Warren County Law Library in the Municipal
Center at
1340 State Route 9, Lake George New York. The law librarian will
assist you in locating these rules. Bear in mind that appeals
must be perfected
within a certain time frame, and one is referred to Rule 202.55
of the Uniform Rules for Trial Courts for that procedure. One
may find it helpful to consult a lawyer, although it is not required.
Those
interested may purchase photocopies of the relevant rules and
see copies of the guides at the Law Library, which is open to
the public
during
regular business hours.
