The Surrogate's Court is established in every county and has jurisdiction over actions and proceedings of decedents, including the probate of wills, intestate estates, small estates, ancillary proceedings, disputed claims, discovery proceedings, accountings, compromise and settlement of wrongful death actions, guardianships of the person and/or property of an infant and Article 17A guardianships, as well as adoptions.
Surrogate's Court filing fees are set by Law to be collected by the Clerk of the Court on the filing of applications requesting relief (petitions). The minimum filing fee is $45.00. The maximum is $l,250.00. See Section 2402 SCPA. |
