Jurisdiction: Finger Lakes (Misdemeanor) Drug Court also designated
"HUB Court" accepts transferred cases from all Town and
Village Courts in Ontario County as well as from Geneva City
Court.
Mission:
The mission of the F.L.D.C. is to protect our community
and decrease costs by reducing the revolving door of crime, substance
abuse and the rate of incarceration.
The F.L.D.C. Requires the increased personal responsibility
of convicted non-violent drug-related offenders by means of intensive
community supervision, thus assisting the offenders to become
productive and responsible members of their families and society.
Additional Information:
The Finger Lakes Drug Court Program will provide services for
defendants charged with misdemeanors as well as probation and
parole violators if the crime(s) are either directly or indirectly
Alcohol/Drug related or Addiction Driven. Cases will not be
accepted if they are Drug Sales, Violent Crimes, Sex Crimes
or involve weapons.
The FLDC accepted its first Drug Court Participant in July 2000.
It is supported by many leaders in the law enforcement community,
Ontario County Alternatives to Incarceration Advisory Board and
the NYS Unified Court System. The FLDC promotes positive interaction
and effectiveness between the criminal justice system, community
treatment agencies and the offenders. It has been proven to be
successful.
Procedure for Referral:
The Defendant is arraigned in criminal court. The case will be
reviewed by the prosecutor and the defense attorney. If the
case meets the criteria for DC, the defendant will be asked
if he/she wants their case transferred to DC. If the defendant
agrees, he/she will be referred to the coordinator to set up
an appointment for a DC Screening. Once screened the defendant’s
case will be assessed by the DC Team for acceptance or denial
to the program. Finally, if all parties involved agree (the
arraigning Judge, prosecutor, defense attorney and the defendant),
then the case will be transferred to the Drug Court, where
the Defendant is required to enter a plea if necessary. He/She
will then sign a Participant’s Agreement and begin the
first of three phases.
The Drug Court process will be a minimum of one year in duration.
The Participant will be require to report to court for a progress
report to be reviewed and discussed by the Judge. Incentive and
graduated sanctions will be handed out by the Judge as deemed
appropriate.
Successful Completion and Graduation:
To graduate you must have achieved a stable living environment,
completed a substance abuse treatment program and have a minimum
of six (6) months straight days clean and sober. You must submit
in writing, an essay stating why you feel that you are ready
to graduate and mail it to the judge prior to staffing one
month before the tentative graduation date. The DC Team will
review Participants achievements and make recommendation to
the Judge. The Judge makes the final decision to graduate the
Participant from the FLDC Program. |
