A Brief Overview
of the Attorney Disciplinary Process

The disciplinary process commences with the filing of a complaint against an attorney, who is referred to as a "respondent". Formal charges are brought on a showing of "probable cause".

The Committee notifies the Appellate Division of a disciplinary matter requiring action by the Court via a petition that describes the prior proceedings and requests a court order (e.g. disbarring or suspending the attorney).
