Appellate Division - First Department
Character & Fitness

The authority of the Appellate Division carries certain administrative responsibilities.

In addition to his duties as a sitting judge, the Presiding Justice of the Appellate Division oversees the administration of several court-related agencies: the character and fitness committee, the departmental disciplinary committee, the special masters program, the office of the law guardian, the assigned counsel plan and the mental hygiene legal service agency.

The character and fitness committee of the First Department, whose members are appointed by the presiding justice, determines the applications of those who seek admission to the Bar.

The reforms of the 1890's , which created the Appellate Division, conferred upon the Court the authority to examine the qualifications and moral character of applicants and rule on their formal admission to the Bar.

   

Today, the 36-member Committee, which is chaired by Boris Kostelanetz, Esq., reviews the lawyers admitted to practice annually in the First Judicial Department. Applicants submit an exhaustive written application which forms the basis for an interview conducted by a member of the Committee.

Successful applicants are inducted into the Bar in a ceremony of timeless dignity held in the historic courtroom at 27 Madison Avenue. In a tradition dating back to the Court’s founding in 1896, the Clerk of Court Administers the oath of office and one of the Justices delivers a welcoming address to the new lawyers. Those who have been thus admitted to the Bar include President Woodrow Wilson, Franklin Delano Roosevelt and Richard Nixon, as well as Supreme Court Justices, Senators and world leaders, and thousands of working attorneys under the aegis of the First Department.
