New York County E-Filing

Electronic Filing in the Commercial Division

Mandatory electronic filing through the New York State Courts Electronic Filing System ("NYSCEF") began in certain commercial cases in New York County Supreme Court on May 24, 2010. All such cases commenced from that date on must be e-filed at the commencement stage and all subsequent documents in such cases must be e-filed thereafter. Rules governing mandatory e-filing are set forth in Uniform Rule 202.5-bb. The Supreme Court, Civil Branch, New York County has promulgated a Protocol on Courthouse Procedures for Electronically Filed Cases that explains how the e-filing program is implemented. The Protocol contains a summary of the definition of a commercial case for e-filing purposes. The full definition is set out in Ch. 416 of the Laws of 2009, as amended by Ch. 528 of the Laws of 2010. Essentially, commercial cases for e-filing purposes are the types of cases that have been eligible for assignment to the Commercial Division (see Uniform Rule 202.70), except that the monetary threshold is generally (there are some exceptions) over $ 100,000 (the Division threshold in New York County is $ 150,000). This means that basically all Commercial Division cases are subject to mandatory e-filing and that some non-Division cases are as well.

Commercial Division cases commenced prior to May 24, 2010 are subject to presumptive e-filing.
