RESOLUTION PART RULES

1. Upon entering the Courtroom, all parties and/or their respective lawyers are to check in with the Clerk of the Part. There is no calendar or roll call.

2. Defaults are taken one hour after the matter is noticed to be heard.

3. With respect to a nonpayment proceeding where the respondent fails to appear, a Judgment will be granted in favor of the petitioner and against the respondent for the amount sought on the petition. Where the petitioner fails to appear, the proceeding will be dismissed. With respect to a holdover proceeding where the respondent fails to appear, the Court will adjourn the proceeding for an Inquest. The Court will send the respondent a postcard notifying the respondent of the adjourned date, time and place. On the adjourned date if the respondent fails to appear the Court will conduct the Inquest. If the respondent appears the Court will conference the proceeding and if a settlement is not possible, send the matter out for trial. If the petitioner fails to appear the proceeding will be dismissed.

4. Oral argument is required on all motions.
