Whalen, Esq. One of the most positive experiences and rewarding duties of a town or village justice is likely to be the performance of a marriage ceremony. The authority for town and village justices to solemnize marriages is set forth in Domestic Relations Law § 1 (3). Solemnization entails that part of the marriage ceremony where the parties must solemnly declare in the presence of the justice and at least one witness that they take each other as husband and wife (DRL §12). The Domestic Relations Law does not provide an age limit to be a witness. However, it is recommended that the witness should he competent to testify in a court proceeding should the solemnization become contested (see, 1967, Op. Atty. Gen. 160). Frequently, parties will request a child to act as a witness and it is recommended that an adult also act as an additional witness in such circumstances.... The New York State Legislature is likely to either extend or make permanent the present experimental legislation allowing audiovisual coverage in the courtroom. Although there may be amendments, one can anticipate that most, if not all of the present statute, will be incorporated into any new legislation, and therefore, it is appropriate to review some of the major aspects of the present law.
