Court-Based Programs Outside
NYC
For mediation in a Family, City or Town or Village court outside of New York City, contact your local Community Dispute Resolution Center or the court.
Many courts offer arbitration for minor civil disputes. Click here to access Part 28 of the Rules of the Chief Judge which govern court-based arbitration programs.
ADR programs in the Supreme Courts are listed below. This list is not exhaustive and new programs are emerging quickly. Speak to your attorney or contact the court where your case is being heard for more information.
7th District: Monroe, Cayuga, Wayne, Seneca, Ontario, Yates, Livingston and Steuben Counties
8th District: Erie, Allegany, Niagara, Cattaraugus, Chautauqua, Orleans, Wyoming and Genesee Counties
9th District: Westchester, Dutchess, Orange, Putnam and Rockland Counties
10th District: Nassau County

Custody & Visitation Mediation in Matrimonial Matters
This program is a district-wide collaboration between the
Supreme Courts in the Seventh Judicial District and the Center
for Dispute Settlement (CDS).
The courts refer parties in pending matrimonial cases to CDS.
Monroe County Supreme Court (Civil Cases)
Parties in selected civil cases are required to attend one
mediation session to discuss their case with a mediator and
explore settlement. The court grants a 30-day stay of court
proceedings while mediation is pending with the possibility
of another 30 day extension.

8th Judicial District
Erie, Allegany, Cattaraugus, Chautauqua, Niagara, Orleans, Genesee, and Wyoming Counties
8th Judicial District Supreme Court ADR Program,
offers many options
for ADR - early neutral evaluation, late neutral evaluation, mediation,
arbitration and summary jury trial. This program includes
commercial cases with special referrals to commercial mediators as well

8th Judicial
District Expedited Matrimonial Part seeks to help resolve matrimonial matters in way that
will be fair, efficient and less expensive than a traditional lawsuit. Court representatives meet with parties to help the two sides
understand one another and where they agree and disagree
on custody (if children are involved), support, property divisions
and reason for divorce, separation or annulment. The Court
representative, attorneys, and parties work toward a full or partial resolution acceptable to both sides.

9th Judicial District
Westchester, Dutchess, Orange, Putnam and Rockland Counties
Westchester County Supreme Court Matrimonial Mediation
Selected matrimonial cases are referred to mediation after a preliminary
conference or at any other time deemed appropriate by the
Judge. Volunteer attorneys who have completed a 32-hour mediation
training sponsored by the court serve on the court's roster
of mediators.
Westchester County Supreme Court Commercial Division The court offers a mediation program for commercial cases.
Selected cases are referred to mediation as soon as possible
after they have been commenced or at any other time deemed
appropriate by the Judge. Volunteer attorneys serve on the
court's roster of mediators. All mediators on the court's
roster completed a court-sponsored, 16-hour mediation training.
Orange County Supreme Court Matrimonial Mediation & Neutral Evaluation
Matrimonial cases can be referred to a multi-step mediation and neutral evaluation
program. The Dispute Resolution Center is a partner in the mediation segment of this program.
After mediation, parties may elect to present
their case to a neutral evaluator to guide them toward
a negotiated resolution. This option is particularly useful
for cases in which issues are unresolved after
mediation and the parties still wish to avoid litigation.

10th Judicial District (Nassau)
Nassau County
Nassau County Supreme Court offers several ADR Programs.
- Neutral Evaluation: After a
preliminary conference or when deemed appropriate
by the Judge, a case can be referred to neutral evaluator - a volunteer attorney who hears case
presentations and provides an evaluation of likely court outcomes
in an effort to guide parties toward a negotiated resolution.
- Voluntary, binding arbitration and neutral evaluation are available
for tort cases.
- The commercial division offers a mediation program.
The Judge may refer cases to mediation. Volunteer attorneys serve on the
court's roster of mediators.
