Since 1990, the Ethics Commission for the Unified Court System has been responsible for the distribution, collection, review and maintenance of the financial disclosure statements required to be filed annually by approximately 5,000 judges, justices and other employees of the court system, pursuant to the Rules of the Chief Judge, 22 NYCRR Part 40. Effective September, 2006, certain candidates for public election to judicial office are also required to file financial disclosure statements, pursuant to the Rules of the Chief Administrator of the Courts, 22 NYCRR Part 100.

ELECTRONIC FILING IS AVAILABLE ON THE INTERNET AND INTRANET. YOU CAN VIEW ALL YOUR PREVIOUSLY FILED ESTATEMENTS. IF YOU FILED ELECTRONICALLY LAST YEAR, YOU CAN COPY INFORMATION FROM THAT STATEMENT INTO YOUR NEW ELECTRONIC STATEMENT. You must file a financial disclosure statement for calendar year 2009 if you are employed by the Unified Court System in 2010 and:

  • you are a state-paid judge or justice, regardless of your annual rate of compensation; or
  • you hold a position for which you receive an annual salary at a rate in excess of $88,256.00, and you have not been otherwise exempted from filing; or
  • you hold a policymaking position for purposes of financial disclosure. List of Designated Policy Makers

Your annual rate of compensation is determined: as of January 1, 2010 if you are employed by the Unified Court System on that date; or as of the date you commence employment, if you are not employed on January 1, 2010.

If you are on a paid or unpaid leave of absence, you remain an employee of the Unified Court System, and you are therefore required to file if you meet any of the above mentioned conditions.

If you are a nonjudicial employee working part-time, and you have not been designated as a policymaker for purposes of financial disclosure, you do not have to file if you will earn less then $88,256.00 in 2010.

You must file if you are a candidate for public election to judicial office. Such filing is not required if you are required to file for the preceding calendar year because you are a state-paid judge or justice, or an employee of the Unified Court System. Such filing is not required if you are a candidate for public election to a Town & Village Court.

Annual Statements of Financial Disclosure for calendar year 2009 filed pursuant to Part 40 are due:

  • May 15, 2010 - if you are employed by the Unified Court System from January 1, 2010 through April 15, 2010; or
  • Within thirty days of the date you commence employment - if you commence employment with the Unified Court System from April 16, 2010 through December 31, 2010.

“Commence Employment” includes a change to a new job title: with a rate of annual compensation in excess of $88,256.00; or that is designated as a policymaking position for purposes of financial disclosure.

Annual Statements of Financial Disclosure for calendar year 2009 filed by judicial candidates pursuant to Part 100 are due within 20 days following the date on which the filer becomes a candidate.
