| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated May 9, 2005, for leave to prosecute the appeal as a poor person and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the appeal is dismissed, without costs or disbursement as no appeal lies from an order denying reargument; and it is further,
ORDERED that the motion is denied as academic.
FLORIO, J.P., RITTER, KRAUSMAN and COVELLO, JJ., concur.
