Motion by New York Newspapers Publishers Association, Inc., Associated Press, Daily News, L.P., and New York Times Company for leave to file an amicus curiae brief on an appeal from an order of the County Court, Dutchess County, dated November 1, 2005, and separate motion by Poughkeepsie Newspapers Division, Gannett Satellite Information Network, Inc., Daniel Shapley, and William V. Grady for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motions and the papers filed in relation thereto, it is
ORDERED that the motions are granted; and it is further,
ORDERED that the amicus curiae brief which was submitted to the Clerk of this court is accepted for filing; and it is further,
ORDERED that no oral argument by the amicus curiae shall be permitted; and it is further,
ORDERED that the parties, if they be so advised, may file reply briefs to the amicus curiae brief on or before January 20, 2006; and it is further,
ORDERED that the appeal will be calendared expeditiously.
