DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the County Court, Nassau County, rendered February 3, 2005, in effect, to extend his time to take an appeal from a resentence of the same court, imposed February 9, 2005, and for leave to serve and file a supplemental brief raising issues relating to the resentence.

Upon the papers filed in support of the motion and the papers filed in opposition or relation thereto, it is

ORDERED that the motion is granted and the defendant's moving papers are deemed to constitute a timely notice of appeal from the resentence; and it is further,

ORDERED that the appellant shall file nine copies of the supplemental brief and serve one copy on the District Attorney on or before March 20, 2006.
