| DECISION & ORDER ON MOTION |
Motion by the respondent for a copy of any and all minutes of the Grand Jury proceedings in the above-entitled case, on an appeal from an order of the County Court, Suffolk County, dated September 26, 2005, and to enlarge his time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, and on or before February 3, 2006, the appellant shall serve upon the respondent's attorney one copy of the Grand Jury minutes in question and shall file one copy of the same with the Clerk of this court, those minutes shall remain under seal, and may be reviewed only by the attorney for the respondent, and the respondent's time to serve and file a brief is enlarged until March 20, 2005.
