DECISION & ORDER ON MOTION

Motion by the nonparty-appellant on an appeal from an order of the Family Court, Suffolk County, dated December 6, 2005, in effect, to amend so much of a decision and order on motion of this court dated December 20, 2005, as conditioned a stay of enforcement of the order dated December 6, 2005, and the interim custody and visitation directives, upon the appeal being perfected on or before January 19, 2006.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the decision and order on motion of this court dated December 20, 2005, is amended by deleting from the decretal paragraphs thereof the date "January 19, 2006," and substituting therefor the date "February 17, 2006"; and it is further,

ORDERED that no further extensions of the stay shall be granted if the appeal is not perfected by February 17, 2006; and it is further,

ORDERED that on the court's own motion, the third decretal paragraph of the decision and order on motion of this court dated December 20, 2005, is amended by deleting therefrom the date January 19, 2006, and substituting therefor the date March 17, 2006.
