| DECISION & ORDER ON MOTION |
Motion by Lisa Nason, in effect, for leave to appeal to this court from an order of the Supreme Court, Westchester County, entered October 31, 2005, and to stay enforcement of an order of the same court entered August 12, 2005, which appointed Marc T. Abrams as a forensic evaluator in the above-entitled action, pending hearing and determination of the appeal from the order entered October 31, 2005, and application by Marc T. Abrams for leave to file papers in opposition to the motion.
Upon the papers filed in support of the motion and the application and the papers filed in opposition or relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this court is denied; and it is further,
ORDERED that the motion is otherwise denied as academic; and it is further,
ORDERED that the application is denied.
