It is ordered that the motion is granted. Appellate Term order, dated August 4, 2005, is modified to the extent of: (1) directing the Appeal's Clerk to file a notice of appeal on behalf of the defendant as to docket number 2005NY021932; (2) upon filing said notice of appeal the defendant-appellant is granted leave to appeal as a poor person and Steven Banks, Esq. of the Legal Aid Society is assigned as counsel for the appellant to prosecute the appeal along with the appeals on docket numbers 2004NY045524 and 2004NY063562.
