It is Ordered that the motion and cross-motion are consolidated for the purpose of disposition. The stay is continued, to and including, February 9, 2006. If, by said date, the appeal has been perfected and the appellant has tendered accruing use and occupancy, along with the additional $500 due per month towards arrears, to the petitioner, without prejudice, then the appellant may move for a further continuation of the stay. Otherwise, the warrant of eviction may be enforced after February 9, 2006.
