It is Ordered that the motion is granted only to the extent of permitting the petitioner-respondent to personally serve and file its answering briefs by January 24, 2006. Reply briefs, if any, are to be served and filed by January 31, 2006. The motion insofar as it seeks to dismiss the appeal as non-appealable is denied, without prejudice to raising the issue in the answering briefs. The cross-motion for a stay of the trial in the summary proceeding is denied.
