It is Ordered that the motion and cross-motion are consolidated for the purpose of disposition. In the event the appeal is not argued or submitted at the April 2006 term - the filing deadline is February 8, 2006, then the petitioner may submit a proposed order for signature, permitting the warrant of eviction to be enforced after February 9, 2006. In the event accruing use and occupancy is not tendered to the petitioner pending the appeal, the petitioner-landlord may move on five days' notice for an order vacating the stay.
