| DECISION & ORDER ON MOTION |
Motion by the respondents for leave to reargue an appeal from an order of the Supreme Court, Westchester County, entered August 25, 2004, which was determined by decision and order of this court dated October 11, 2005.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and upon reargument, the decision and order of this court dated October 11, 2005, is amended by (1) deleting the third decretal paragraph thereof and (2) adding to the second decretal paragraph after the words "on the law," the words "without costs or disbursements."
