Motion by Brennan Center for Justice at NYU Shcool of Law for leave to file an amicus curiae brief on an appeal from an order of the Supreme Court, Kings County, dated December 20, 2005, as amended December 21, 2005.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
