| DECISION & ORDER ON MOTION |
Motion by the respondent in a proceeding prusuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Kings County, dated March 16, 2005, inter alia, to transfer the proceeding to the Supreme Court, Kings County, or, alternatively, to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the branch of the motion which is to transfer the appeal to the Supreme Court, Kings County, is denied; and it is further,
ORDERED that the motion branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until March 8, 2006, and the respondent's brief must be served and filed on or before that date.
