DECISION & ORDER ON MOTION

Motion by the respondent to enlarge the time to serve and file a brief on an appeal from a judgment of the County Court, Dutchess County, rendered January 8, 2001, and, in effect, for an order directing the Clerk of this court or his designee to provide the respondent with a copy of the plea and sentencing minutes in the above-entitled action.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted, and the respondent's time to serve and file a brief is enlarged until March 3, 2006, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the branch of the motion which is, in effect, for an order directing the Clerk of this court or his designee to provide the respondent with a copy of the plea and sentencing minutes in the above-entitled action is granted, and the Clerk of this court or his designee is directed to provide the respondent with a copy of the plea and sentencing minutes in the above-entitled action.
