DECISION & ORDER ON MOTION

Motion by the nonparty-appellant to stay all proceedings in Proceeding No. 2, pending determination of appeals from three resettled orders and judgments (one paper as to each) of the Supreme Court, Kings County, two dated August 9, 2004, and one dated August 11, 2004.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that the delivery of the deed to the subject premises is stayed pending determination of the appeals, and the motion is otherwise denied.
