DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from an order of the Supreme Court, Nassau County, entered March 17, 2005, inter alia, for leave to serve and file a supplemental record containing the underlying motion papers submitted in connection with a motion to dismiss the complaint made by the defendant Garden City Teachers Association, Inc., and to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the stipulation of the parties dated December 16, 2005, it is

ORDERED that the branch of the motion which is for leave to serve and file a supplemental record containing the underlying motion papers submitted in connection with a motion to dismiss the complaint made by the defendant Garden City Teachers Association, Inc., is granted and on or before March 20, 2006, the respondent shall serve and file a supplemental record on appeal containing that material; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until March 20, 2006, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
