DECISION & ORDER ON MOTION

Motion by the respondent for reinstatement as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on March 16, 1977. By opinion and order of this court dated February 26, 1990, the respondent was disbarred, based upon his plea of guilty on February 7, 1989, in the Supreme Court, Suffolk County, to grand larceny in the third degree in violation of Penal Law §155.35, a class D felony.

Upon the papers filed in support of the present motion and the papers filed in response thereto, it is

ORDERED that the motion is denied.

We find that the respondent does not demonstrate the requisite character and fitness to practice law.
