In the Matter of Joanne Monticciolo, respondent,

v Alfred Saracco, appellant.

(Docket No. F-1125-04)

DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, for leave to appeal to this court from two orders of the Family Court, Richmond County, dated January 4, 2006, and February 14, 2006, respectively, and to stay the enforcement of the order pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal from the orders is denied as unnecessary, as the orders are appealable as of right (see Family Ct Act 1112); and it is further,

ORDERED that the motion is otherwise denied.
