| DECISION & ORDER ON MOTION |
Appeal by Christopher Bascom from an order of the County Court, Nassau County, dated November 23, 2005. By decision and order on motion dated January 10, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal in the above-entitled action on the ground that the order dated November 23, 2005, is not appealable by right or permission (see CPL 450.10; 450.15) by filing an affidavit or affirmation on that issue with the Clerk of this court on or before January 27, 2006.
Now, on the court's own motion, and upon the papers filed in response to the order to show cause, it is
ORDERED that the appeal is dismissed, on the ground that the order dated November 23, 2005, is not appealable by right or permission (see CPL 450.10; 450.15).
