It is ordered that the motion is granted to the extent of directing the Appeals Clerk of Bronx County Criminal Court to file a notice of appeal on behalf of the defendant. That branch of the motion seeking permission to appeal as a poor person and for the assignment of counsel is denied without prejudice to renew upon submission of an affidavit by the defendant -appellant detailing income and assets.
