Motion by the respondent to dismiss appeals from two judgments of the Supreme Court, Suffolk County, entered May 4, 2005, and May 5, 2005, respectively, or, alternatively, to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeals is denied in light of the decision and order on motion of this court dated January 31, 2006; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is denied with leave to renew purusant to 22 NYCRR 670.8(d)(2), if the appeal is perfected.
