DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from an order of the Supreme Court, Nassau County, dated May 25, 2005, to direct the appellant to pay the costs of printing her brief on the appeal and to pay her attorney's fees for the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to direct the appellant to pay the respondent's attorney's fees for the appeal is denied, without prejudice to seeking relief in the Supreme Court, Nassau County; and it is further,

ORDERED that the branch of the motion which is to direct the appellant to pay the costs of printing the respondent's brief on the appeal is denied as premature, as the issue of costs will be determined on the appeal.
