DECISION & ORDER ON MOTION

Motion by the appellant, inter alia, to stay enforcement of a judgment of Supreme Court, Nassau County, dated December 7, 2005, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the branch of the motion which is to stay enforcement of so much of the judgment as directed the parties to arbitrate any appropriate issues relating to their separation agreement, which was incorporated but not merged into the judgment, is granted and, pending hearing and determination of the appeal, so much of the judgment as directed the parties to arbitrate any appropriate issues relating to their separation agreement is stayed; and it is further,

ORDERED that the motion is otherwise denied.
