| DECISION & ORDER ON MOTION |
Motion by the appellant for a preference in the calendaring of an appeal from a judgment of the Supreme Court, Orange County, dated February 17, 2006.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that on the court's own motion the notice of appeal from a decision of the same court dated August 1, 2005, is deemed a premature notice of appeal from the judgment (see CPLR 5520[c]); and it is further,
ORDERED that on or before April 7, 2006, the appellant shall serve and file a supplemental record containing the judgment dated February 17, 2006; and it is further,
ORDERED that the motion is granted, and the appeal will be calendared expeditiously.
