Motion by the appellant, inter alia, in effect, to recall and vacate a decision and order on motion of this court dated January 27, 2004, which dismissed an appeal from an order of the Family Court, Queens County, dated February 14, 2003, in the above-entitled proceeding for failure to comply with a scheduling order dated August 8, 2003, issued pursuant to 22 NYCRR 670.4(a)(2), to reinstate the appeal, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in relation or opposition thereto, it is
ORDERED that the motion is denied.
