| DECISION & ORDER ON MOTION |
Motion by the nonparty, Richard Cella, on an appeal from an amended judgment of foreclosure and sale of the Supreme Court, Nassau County, entered June 23, 2005, inter alia, to stay the sale of the subject premises, pending hearing and determination of the appeal, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for a stay is denied; and it is further,
ORDERED that the branch of the motion which is to enlarge time is granted; and it is further,
ORDERED that the appellant's time to perfect the appeal is enlarged until May 15, 2006, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
