| DECISION & ORDER ON MOTION |
Motion by the respondent for an order, pursuant to CPLR 2221 and 22 NYCRR 691.11(a), modifying this court's opinion and order dated May 12, 2003, which suspended him from the practice of law for a period of three years, based upon his conviction of serious crimes, to allow him to apply for reinstatement within six months before the expiration of his three year period of suspension. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Third Judicial Department on February 18, 1975.
Upon the papers submitted in support of the motion and the papers submitted in response thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the opinion and order of this court dated May 12, 2003, is amended by deleting from the second decretal paragraph thereof, the word "after," following the words "apply for reinstatement," and substituting therefor the words "no sooner than six months prior to."
