DECISION & ORDER ON MOTION

Appeal by the defendant from an order of the Supreme Court, Kings County, entered January 4, 2006. By order to show cause dated February 15, 2006, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal on the ground that the order dated entered January 4, 2006, is not appealable by right or by permission (see CPL 450.10, 450.15).

On the court's own motion, and no papers having been filed in response to the order to show cause, it is

ORDERED that the motion is granted and the appeal is dismissed.
