DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by the respondent for reargument of his prior motion for reinstatement which was denied by decision and order of this court dated November 21, 2005, and, upon reargument, for an order pursuant to 22 NYCRR 691.11(d) holding his motion for reinstatement in abeyance and referring this matter to the Committee on Character and Fitness or to a referee, justice, or judge for a report. The respondent was admitted to the practice of law at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on December 18, 1963. By opinion and order of this court dated September 8, 1997, he was disbarred on charges involving the submission of false and fraudulent affidavits, affirmations, and proof of claim to the Bankruptcy Court, and the billing for a guardian ad litem when none had been appointed.

Upon the papers before the court, it is

ORDERED that the motion is denied.
