It is Ordered that the motion is granted only to the extent of staying the execution of the warrant of eviction, to and including, April 10, 2006. This is to afford the appellant a final opportunity to perfect the appeal from an order granting summary judgment to the petitioner-landlord. [ see 22 NYCRR § 640.6] The arrears outstanding are to be tendered to the petitioner-landlord, without prejudice, by March 24, 2006. In the event the appeal has been perfected for the June 2006 term and the appellant is current in the payment of use and occupancy, the appellant may move for a further continuation of the stay. Otherwise, the warrant of eviction may be enforced after April 10, 2006. No further extension of time will be granted in this appeal involving a non-regulated respondent whose lease has long expired.
