It is Ordered that the motion is granted only to the extent of staying the re-letting of the premises on condition that the appellant: 1- on or before March 22, 2006, pays the amount due under the stipulation ( $8,707.57), along with "rental" payments for January, February and March, at $2,134.17 per month, to the petitioner, without prejudice; 2- on or before April 4, 2006, deposits $6,259.51 with the Clerk of the Civil Court, representing the cost to the landlord of the two evictions of the appellant; and 3- perfects the appeal by the June 2006 term - the filing deadline is April 11, 2006. Pending the determination of the appeal, the appellant is to tender $2,134.17 each month to the petitioner, without prejudice. In the event of appellant's failure to comply with the foregoing conditions, petitioner may move on five days' notice for an order vacating the stay of the re-letting of the premises.
