DECISION

On the court's own motion, appeal by tenant-appellant, as limited by his brief, from so much of an order of the Civil Court of the City of New York, Kings County (O. Chin, J.), dated June 16, 2005, as denied his motion to dismiss is dismissed.

The appeal from the intermediate order must be dismissed because the petition was dismissed after trial.
