SUPREME COURT OF THE STATE OF NEW YORK

APPELLATE TERM: 9th and 10th JUDICIAL DISTRICTS

PRESENT : RUDOLPH, P.J., ANGIOLILLO and TANEBAUM, JJ.

NO. 2005-1129 W C
SUZANNE CORRADO,

Respondent,

-against-

PATRICIA HARRIS and WILLIE RICHBOURGH,

Appellants.

DECISION

Motion by tenant-appellant Patricia Harris to strike landlord-respondent's brief and appendix and cross motion by landlord-respondent for, inter alia, costs and sanctions denied. On the court's own motion, the appeal, insofar as it is taken by tenant-appellant Willie Richbourgh is dismissed.

We note that tenant-appellant Willie Richbourgh failed to appear in the proceeding and that no appeal lies from a judgment or order entered upon default.
