| DECISION & ORDER ON MOTION |
Motion by the defendant for leave to appeal to this court from an order of the Supreme Court, Kings County, dated March 1, 2006, and a decision of the same court dated February 8, 2006, to stay enforcement of the order and the decision, to enlarge the record on the appeals to include a State Department travel warning issued on February 27, 2006, and for a preference in the hearing and determination of the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
The order is appealable as of right and not by permission (see CPLR 5701[a][2][v]; see also CPLR 5514[a]). However, no appeal lies from a decision (see Schicchi v Green Constr. Corp., 100 AD2d 509).
