| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to prosecute an appeal from a judgment of the Supreme Court, Richmond County, dated May 31, 2005, as a poor person, to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the appendix, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion which is to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the appendix is granted; and it is further,
ORDERED that the motion is otherwise denied as academic, as the appeal was timely perfected and the filing fee paid on February 21, 2006.
