Motion by the appellant to amend the notice of appeal from an order of the Surrogate's Court, Kings County, dated July 15, 2005, to reflect that the appeal is taken by Alvin Lapides and not Howard L. Rhine.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the motion is granted, and the notice of appeal is deemed amended to reflect that the appeal is taken by Alvin Lapides (see CPLR 2001).
