DECISION & ORDER ON MOTION

Motion by the respondent to dismiss an appeal from an order of the County Court, Orange County, dated January 30, 2006, on the ground that the order is not appealable.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion is granted and the appeal is dismissed, as the order is not appealable (see CPL 450.10; 450.15).
